CARACAS, Venezuela (AP) ? Venezuelan President Hugo Chavez is confronting "new complications" due to a respiratory infection nearly three weeks after undergoing cancer surgery, his vice president said in Cuba as he visited the ailing leader for the first time since his operation.
Vice President Nicolas Maduro looked weary and spoke with a solemn expression in a televised address from Havana on Sunday. He described Chavez's condition as delicate.
"Several minutes ago we were with President Chavez. We greeted each other and he himself referred to these complications," Maduro said, reading from a prepared statement.
The vice president's comments suggest an increasingly difficult fight for Chavez. The Venezuelan leader has not been seen or heard from since undergoing his fourth cancer-related surgery Dec. 11, and government officials have said he might not return in time for his scheduled Jan. 10 inauguration for a new six-year term.
"The president gave us precise instructions so that, after finishing the visit, we would tell the (Venezuelan) people about his current health condition," Maduro said. "President Chavez's state of health continues to be delicate, with complications that are being attended to, in a process not without risks."
Maduro was seated alongside Chavez's eldest daughter, Rosa, and son-in-law Jorge Arreaza, as well as Attorney General Cilia Flores. He held up a copy of a newspaper confirming that his message was recorded on Sunday.
"Thanks to his physical and spiritual strength, Comandante Chavez is facing this difficult situation," Maduro said.
Maduro said he had met various times with Chavez's medical team and relatives. He said he would remain in Havana "for the coming hours" but didn't specify how long.
Maduro, who arrived in Havana on Saturday for a sudden and unexpected trip, is the highest-ranking Venezuelan official to see Chavez since the surgery in Cuba, where the president's mentor Fidel Castro has reportedly made regular visits to check on him.
Before flying to Cuba, Maduro said that Energy Minister Hector Navarro would be in charge of government affairs in the meantime.
"The situation does not look good. The fact that Maduro himself would go to Cuba, leaving Hector Navarro in charge only seems understandable if Chavez's health is precarious," said David Smilde, a University of Georgia sociologist and analyst for the Washington Office on Latin America think tank.
Smilde said that Maduro probably made the trip "to be able to talk to Chavez himself and perhaps to talk to the Castros and other Cuban advisers about how to navigate the possibility of Chavez not being able to be sworn in on Jan. 10."
"Mentioning twice in his nationally televised speech that Chavez has suffered new complications only reinforces the appearance that the situation is serious," Smilde said.
Before his operation, Chavez acknowledged he faced risks and designated Maduro as his successor, telling supporters they should vote for the vice president if a new presidential election were necessary.
Chavez said at the time that his cancer had come back despite previous surgeries, chemotherapy and radiation treatment. He has been fighting an undisclosed type of pelvic cancer since June 2011.

Information Minister Ernesto Villegas defended the government's handling of the situation, saying during a televised panel discussion on Sunday night that Chavez "has told the truth in his worst moments" throughout his presidency.
He also referred to a new surge of rumors about Chavez's condition and called for respect for the president and his family.
Villegas said a government-organized New Year's Eve concert in a downtown Caracas plaza had been canceled, and he urged Venezuelans to pray for Chavez.
Chavez's daughter Maria, who has been with the president since his surgery, said in a message on her Twitter account: "Thank you people of Venezuela. Thank you people of the world. You and your love have always been our greatest strength! God is with us! We love you!"

NLRB Rules Employer?s Termination of Non-Union Employees for Facebook Posts Violated NLRA

In another decision that affects non-union as well as union employers, the National Labor Relations Board recently ruled that comments posted on Facebook are protected in the same manner and to the same extent as comments made at the "water cooler." In Hispanics United of Buffalo, 359 NLRB No. 37 (Dec. 14, 2012), the Board found that a non-union employer's termination of five employees for Facebook postings was unlawful, awarding the employees full reinstatement and backpay.
The controversy began when one employee ? Lydia ? criticized the work of five of her co-workers. One of the criticized employees ? Marianna ? sent this message from her personal computer at home to the other four employees:
"Lydia . . . feels that we don't help our clients enough . . . . I about had it! My fellow coworkers how do u feel??
The employees were not amused and, while off duty, posted messages on Marianna's Facebook page making that clear. Lydia also responded on the same Facebook page, demanding that the four "stop with ur lies about me." She then complained to her supervisor that the postings violated the employer's "zero tolerance" policy against "bullying and harassment." The employer investigated and, agreeing with Lydia that its policy had been violated, fired Lydia's five co-workers.
The NLRB upheld an administrative law judge's decision that the terminations violated the National Labor Relations Act (the "Act"), even though no union was involved. The Board concluded that whether the comments were made on line, by way of social media, or "around the water cooler" was irrelevant to the analysis. Instead, the Board focused on whether the postings were:
"Concerted" activity under the Act;
Known to be concerted by the employer's supervisor, who was shown the postings;
"Protected" under the Act; and
The motivation for the terminations.
The second and fourth elements were undisputed.1 On the first and third elements, the Board, with Member Hayes dissenting, found against the employer. The postings were concerted, the Board concluded, because it was "implicitly manifest" that the co-workers' postings had the "clear 'mutual aid' objective of preparing [the] coworkers for a group defense to [Lydia's] complaints." As to the third element, the Board considered the postings protected because they related to the employees' job performance and objectively could not be considered "bullying" or "harassing." The dissent objected to the majority's reasoning, finding there was "insufficient evidence that either the original posting or the views expressed in response to it were for mutual aid or protection." Specifically, Member Hayes emphasized, "the mere fact that the subject of discussion involved an aspect of employment?i.e., job performance?is not enough to find concerted activity for mutual aid and protection. There is a meaningful distinction between sharing a common viewpoint and joining in a common cause."
The decision is yet another by the NLRB that is directed to non-union employers in addition to employers whose employees are represented by a union. In the last year, the NLRB has invalidated the mandatory arbitration agreement of a non-union employer2 and terms in non-union employers' employee handbooks.3 It has also struck down a provision in a company's at-will employment agreement that prohibited employees from disclosing "confidential information," including "personnel information," to individuals "outside the organization."4 There is little reason to believe this trend will abate or even slow in the coming year.
A first key lesson to be learned from this and other recent cases is the importance for all employers, whether union or non-union, of reviewing all employee-related policies with an experienced labor attorney who is familiar with the NLRB and the National Labor Relations Act. A good starting place would be the employer's social media policy, followed by a review of any arbitration agreements and the employee handbook.
Second, all employers should be cautious when basing employment decisions on Facebook or other social media postings. In addition to the issues raised in Hispanics United of Buffalo, there are privacy issues that can arise. Employers should consider postings, such as those in Hispanics United of Buffalo, to be analogous to conversations on non-work time at the "water cooler." Despite the potential for social media "discussions" to be played and replayed to an extremely wide audience, the NLRB will analyze their protected nature the same way that it analyzes a whispered conversation in the employee lunch room or parking lot.
Finally, whenever employer discipline or other adverse employment actions are based on employee communications, employers should consult counsel to make certain the speech is not "concerted, protected" speech under the Act.

WINSTON-SALEM, North Carolina (Reuters) - The severe winter weather that hit parts of the central and southern United States on Christmas Day moved eastward on Wednesday, with forecasters predicting heavy snow in the Ohio Valley and possible tornadoes in the coastal Carolinas.
The National Weather Service issued blizzard and winter storm warnings in Illinois, Indiana and Ohio, as well as much of the Northeast, and warned motorists of "treacherous" driving conditions in those areas.
At airports across the Northeast, holiday travelers braced for flight delays. Some flights headed for Newark Liberty International Airport in New Jersey were experiencing delays of more than an hour on Wednesday because of the inclement weather.
The NWS said more than six inches of snow might fall in those regions, while the area from western New York up into central Maine could get from 12 to 18 inches.
As of Wednesday morning, Bloomington, Indiana, already had nearly a foot of snow and Indianapolis had about seven inches, according to AccuWeather.com.
Severe thunderstorms and widespread rain were expected from southeast Virginia to Florida, with the eastern counties in North Carolina and South Carolina under a tornado watch, the NWS said.
The wet and snowy conditions follow a major winter storm system that swept through the southern United States on Tuesday, spawning tornadoes in several states and causing the death of two people in weather-related road accidents.
Twisters struck in Alabama, Mississippi, Texas and Louisiana, flattening houses and causing injuries, according to the weather service.
Declaring a state of emergency, Mississippi Governor Phil Bryant deployed resources to the multiple counties in that state that reported damaged homes and businesses, power outages and flooding.
Tuesday's storms also contributed to a 21-vehicle pile-up that shut Interstate 40 in downtown Oklahoma City and caused power outages for tens of thousands of residents.
A Texas man died after an accident involving a toppled tree in the road, and there was another weather-related fatality on I-44 in Oklahoma, according to local authorities.

JERUSALEM (Reuters) - Israel voiced doubt on Tuesday about the accuracy of Syrian activists' reports that chemical weapons had been used against rebels fighting to topple President Bashar al-Assad.
"We have seen reports from the opposition. It is not the first time. The opposition has an interest in drawing in international military intervention," Vice Prime Minister Moshe Yaalon said on Army Radio.
"As things stand now, we do not have any confirmation or proof that (chemical weapons) have already been used, but we are definitely following events with concern," he said.
The Syrian Observatory for Human Rights gathered activist accounts on Sunday of what they said was a poison gas attack in the city of Homs. The reports are difficult to verify, as the government restricts media access in Syria.
The Observatory, a British-based group with a network of activists across Syria, said those accounts spoke of six rebel fighters who died after inhaling smoke on the front line of Homs's urban battleground. It said it could not confirm that poison gas had been used and called for an investigation.
Syria has said it would never use chemical weapons against its citizens.
Asked about images purported to show patients being treated for possible gas poisoning, Yaalon said: "I'm not sure that what we're seeing in the photos is the result of the use of chemical weapons.
"It could be other things," he said, without elaborating.
On Sunday, senior Israeli defense official Amos Gilad said Syria's chemical weapons were still secure despite the fact that Assad had lost control of parts of the country.
As Syria's southern neighbor, Israel has been concerned about chemical weapons falling into the hands of Islamist militants or Lebanese Hezbollah fighters, cautioning it could intervene to stop such developments.

After creating his own genre with ?Reservoir Dogs? and ?Pulp Fiction,? Quentin Tarantino has spent the majority of his filmmaking career since making all sorts of genre films that he grew up on, with ?Kill Bill,? ?Death Proof? and ?Inglorious Basterds.? Tarantino is at it again, tackling the spaghetti Western with ?Django Unchained.?
Django (Jamie Foxx) is a quiet, angry man. Separated from his wife after they try to flee the plantation they live on, he?s left walking in shackles towards whatever person wants to purchase him when Dr. King Schultz, a dentist turned bounty hunter (Christoph Waltz) frees him. Django?s saving grace is he knows the Brittle brothers, three men Schultz wants to collect the bounty on. In exchange for helping Schultz, Django is taught the tools of the bounty hunter trade, which mainly involves killing people, and together they will rescue Django?s wife from Calvin Candie, a large plantation owner.
As Candie, Leonardo DiCaprio channels all of his charisma into making the character one of the most despicable Tarantino has ever created. The man is rotten to the core. Even his teeth are black. Candie is every bit as charming as Christoph Waltz?s Hans Landa in ?Inglorious Basterds,? but lacks almost all of the viciousness, which is left to his house slave Stephen (a brilliant Samuel L. Jackson). He?s an amazing villain, but Tarantino uses him all wrong. ?Django? itself really slows down once Candie appears, as Schultz and Django go from hunting down people to sitting around tables, negotiating with the man to get Django?s wife back.
Jamie Foxx?s Django is cut from the mold of the classic Western gunslinger, almost too much so. Django is very much a blank slate on his first appearance, and as the film continues he becomes more fleshed out, but there just isn?t much to him except that he wants his wife back.
The real treat is Christoph Waltz, who won an Oscar for his performance in ?Basterds.? Tarantino may have (moreso than Jackson) found his muse, the Robert DeNiro to his Martin Scorcese. Nobody delivers Tarantino?s dialogue with the perfect mix of charm and irony like Waltz. Every film Tarantino has made since ?Kill Bill? has been very aware that its a movie, and Waltz, who is from Austria, has the perfect voice and mannerisms to personify Tarantino?s style.
?Django? has a lot of things going for it, but it?s not one of Tarantino?s finest. It?s definitely one of his bloodiest films, but at 165 minutes, its bloated and loses entirely too much momentum as things go on. Even Candie, the main villain, doesn?t appear until maybe 90 minutes into the film. Not to mention the ridiculously excessive use of the n-word, which is uttered at least 300 times. Tarantino may be trying to be authentic to the time period, but at some point it just becomes too much. In fairness, every Tarantino film I?ve seen since ?Kill Bill? has felt overlong and self-indulgent on the first viewing, so ?Django? may be much better on a second viewing for me.
It?s been fun seeing Quentin Tarantino provide his own spin on classic movie genres and making them his own. With ?Basterds? and ?Django,? it feels like he?s entering a new phase of his career, where he is purely a genre filmmaker. Hopefully he?ll try and do something entirely new and give the world another ?Pulp Fiction,? but that?s probably just wishful thinking on my part.

There is a mountain of speculation and debate about what school and learning will look like in the near future. Will education be online? Individualized? Self-paced? Flipped? Hybridized? Maybe even completely irrelevant? Rarely, however, is much speculation given to the role of the educator in the future of learning. All people seem to want to know is whether lectures are better recorded or in person or if educators at every level are giving students enough real world skills to be successful in the global economy. In reality, however, the radical changes in technology and the increasing demands on teachers are going to fundamentally change the very act of teaching. What will the educator of the future look like? How will the job description and qualifications change? And what effect will all of that have on students?
The Future of Learning
An October, 2012 video released by telecom company Ericsson presents a survey of educational experts and entrepreneurs speculating about the future of education. This promotional video for the company relies heavily on Knewton and Coursera as the models for the kinds of adaptive, individualized technology that will drive learning in the future.
The focus of the video is the ability of these technologies to track minute user data and facilitate intimately individualized instruction based on that data, including student learning preference, peak performance times, prior knowledge, and a host of other information. Even so, teaching and the role of the instructor was largely missing from this conversation about the techno-facilitated future of education.? One rather vague reference to the role of the educator was attributed to Coursera CEO Daphne Koller in an article accompanying the piece on GIGAOM:
?Coursera?s Koller says one of the revolutions in education is that teaching will be less about conveying information and more of a return to its original roots where instructors engage in dialogue, develop critical thinking skills and spark passion about a discipline.? (23 Oct., 2012)
The Role of the Educator on an Individualized World?
The Koller quote indicates that teaching will take a step backward (historically) with the implementation of these new technologies. Pretty far back, to the time of Plato, in fact, where the teaching and learning process was more about interpersonal interaction and fostering the individual ability to critically apply knowledge and cultivate individual passions for learning. While that is a wonderful plan, it is nearly impossible to imagine a way in which it could happen in a world where a factory model of education still dominates and teachers are overwhelmed with dozens of students in a single class. Plato never had 30 students following him around all attempting to interact at the same time. Given the reality of our education system, here are some more realistic roles for instructors in the world of high-tech education:
Facilitator/Learning Manager: If instructional materials really become individualized to the extent that the video describes, there will need to be someone present to help students navigate the technical aspects of performing the work that the system pushes to them. Additionally, the instructor will have a role in keeping students on task, and in providing support when learners fail to reach the standards pre-programmed into the adaptive learning system. There may also be an increased role in making sure that each student is completing their own work, rather than the work of peers.
Remediator: When students fail to achieve the learning objectives outlined by the automated system, the instructor will need to step in to troubleshoot the learning disconnect and either provide alternative instruction or adjust the learning system through some sort of control interface.
Enricher: Playing off the flipped classroom model, the teacher?s role could shift to providing enrichment activities beyond the scope of the automated system. If adaptive content is provided that helps students master basic concepts and learn background information, teachers can focus on helping students use the information that they have gained in authentic ways to help turn it into knowledge.
Collaborator/Mentor: One intriguing possibility in a technology-facilitated education future is for teachers to serve as collaborators and mentors with students engaging in real world, possibly entrepreneurial, activities. Such activities would help students develop actual marketable skills and could potentially provide a new and much needed revenue stream for schools and universities.
Content Creator: One role that teachers already have ?unless their curriculum is standardized- is that of content creator. This is actually one of the most important functions that educators at all levels perform, and one for which they are well trained. Add to these qualifications the fact that they actually know their students, their strengths, weaknesses, and capabilities, and educators could become a valuable resource to be employed to help bolster the content in these adaptive systems. This serves the additional purpose of de-centralizing the curriculum so that a diverse set of perspectives and ideas can be assured.
N/A: It is possible, though fairly far-fetched, that the further refinement of these adaptive learning systems will make educators obsolete. The Internet is rapidly becoming a repository for all human knowledge (information), and there is potential for these systems to become sophisticated enough to take existing content and reformulate it to create new learning opportunities. This is a frightening possibility that seems awfully close to the scenario that serves as the backdrop for the Terminator movies though.
While it is exciting to think about the rich possibilities that these new technologies could provide for students and the potential they have for liberating teachers from much of the routine, standardized content that all students must master in order to be successful. It is important to remember that true learning happens in context and through a socially mediated process of meaning making.? No technology can accomplish that (yet?), so we will need to keep teachers around to provide the most important aspect of education ? the human touch.

Research from an international team of microbiologists has revealed a new concern about deforestation in the Amazon rainforest a troubling net loss in the diversity among the microbial organisms responsible for a functioning ecosystem.
The group, which includes professors from The University of Texas at Arlington, University of Oregon, University of Massachusetts, Michigan State University and University of Sao Paulo, sampled a 100 square kilometer area, about 38 square miles, in the Fazenda Nova Vida site in Rondnia, Brazil, a location where rainforest has been converted to agricultural use. Their findings in part validated previous research showing that bacteria in the soil became more diverse over the years, as it was converted to pasture.
But their findings contradicted prior thinking by showing that the loss of restricted ranges for different kinds of bacteria communities resulted in a biotic homogenization and net loss of diversity overall. Scientists worry that the loss of genetic variation in bacteria across a converted forest could reduce ecosystem resilience.
"We have known for a long time that conversion of rainforest land in the Amazon for agriculture results in a loss of biodiversity in plants and animals. Now we know that microbial communities which are so important to the ecosystem also suffer significant losses," said Jorge Rodrigues, the University of Texas at Arlington assistant biology professor who was part of the research team and is first author on a recent publication of the findings.
The new research is described in a paper appearing online the week of Dec. 24-28 in advance of publication in the Proceedings of the National Academy of Sciences. The paper is called "Conversion of the Amazon rainforest to agriculture results in biotic homogenization of soil bacterial communities."
Klaus Nsslein, project director for the published research and associate professor of microbiology at the University of Massachusetts, said the team found important differences between the pasture and forest soil. For example, the number of bacterial species in the pasture soil was higher, but those species were also less related to one another than species in the forest soil.
"The combination of loss of forest species and the homogenization of pasture communities together signal that this ecosystem is now a lot less capable to deal with additional outside stress," Nsslein said.
In addition to Rodrigues and Nsslein, co-authors of the paper include: Babur Mirza, UT Arlington; Vivian Pellizari, Siu Mui Tsai, Brigitte Feigl and Fabiana Paula, the University of Sao Paulo (Brazil); Rebecca Mueller and Brendan Bohannan, University of Oregon; Kyunghwa Baek and George Hamaoui, University of Massachusetts; Ederson da C. Jesus, Embrapa-Agrobiologia (Brazil) and James Tiedje, Michigan State University.
"Our findings are especially important because they support the idea that microbes are impacted by human-caused environmental change," said Bohannan, director of the University of Oregon's Center for Ecology and Evolutionary Biology. This knowledge is important because microbes are responsible for critical environmental processes, such as the recycling of nutrients, the production of clean water and the removal of pollutants, Bohannan said.
Tiedje said the unique study was conducted on a scale that had not been attempted before.
"The systematic and large-scale sampling design of this study gave us the power to see the homogenization," he said.
Scientists on the research team hope their work will provide valuable data to those making decisions about the future of the Amazon rainforest.
"The Amazon represents half of the world's rainforest and is home to one-third of Earth's species, yet the Amazon has one of the highest rates of deforestation," co-authors Pellizari, Tsai and Feigl said in a joint statement. "Agriculture is one of the largest and most dynamic parts of Brazil's economy, so dealing with standing rainforests in the tropics will be tricky, but nevertheless, it is vital that the issue is tackled."
Rodrigues said the research team is currently compiling findings about the potential for recovery of the microbial diversity after pastureland is abandoned and returned to "secondary forest."
"Whether bacterial diversity will completely recover from ecosystem conversion will depend in part on whether the taxa lost due to conversion are truly locally extinct or whether they are present in the pasture sites but of such low abundance that they are undetectable in our study," the paper said.

Dec. 23, 2012 ? A research team led by biogeochemists at the University of California, Riverside has tested a popular hypothesis in paleo-ocean chemistry, and proved it false.
The fossil record indicates that eukaryotes -- single-celled and multicellular organisms with more complex cellular structures compared to prokaryotes, such as bacteria -- show limited morphological and functional diversity before 800-600 million years ago. Many researchers attribute the delayed diversification and proliferation of eukaryotes, which culminated in the appearance of complex animals about 600 million years ago, to very low levels of the trace metal zinc in seawater.
As it is for humans, zinc is essential for a wide range of basic cellular processes. Zinc-binding proteins, primarily located in the cell nucleus, are involved in the regulation of gene transcription.
Eukaryotes have increasingly incorporated zinc-binding structures during the last third of their evolutionary history and still employ both early- and late-evolving zinc-binding protein structures. Zinc is, therefore, of particular importance to eukaryotic organisms. And so it is not a stretch to blame the 1-2-billion-year delay in the diversification of eukaryotes on low bioavailability of this trace metal.
But after analyzing marine black shale samples from North America, Africa, Australia, Asia and Europe, ranging in age from 2.7 billion years to 580 million years old, the researchers found that the shales reflect high seawater zinc availability and that zinc concentrations during the Proterozoic (2.5 billion to 542 million years ago) were similar to modern concentrations. Zinc, the researchers posit, was never biolimiting.
Study results appear online Dec. 23 in Nature Geoscience.
"We argue that the concentration of zinc in ancient marine black shales is directly related to the concentrations of zinc in seawater and show that zinc is abundant in these rocks throughout Earth's history," said Clint Scott, the first author of the research paper and a former UC Riverside graduate student. "We found no evidence for zinc biolimitation in seawater."
Scott, now a research geologist with the U.S. Geological Survey, explained that the connection between zinc limitation and the evolution of eukaryotes was based largely on the hypothesis that Proterozoic oceans were broadly sulfidic. Under broadly sulfidic conditions, zinc should have been scarce because it would have rapidly precipitated in the oceans, he explained.
"However, a 2011 research paper in Nature also published by our group at UCR demonstrated that Proterozoic oceans were more likely broadly ferruginous -- that is, low in oxygen and iron-rich -- and that sulfidic conditions were more restricted than previously thought," said Scott, who performed the research in the lab of Timothy Lyons, a professor of biogeochemistry and the principal investigator of the research project.
The research team argues that ferruginous deep oceans, combined with large hydrothermal fluxes of zinc via volcanic activity on the seafloor, maintained high levels of dissolved zinc throughout the oceans and provided a relatively stable marine reservoir of the trace metal over the past 2.7 billion years.
"The key challenge in understanding the early evolution of life is recognizing the environmental conditions under which that life first appeared and diversified," Lyons said. "We have taken a very direct approach that specifically tracks the availability of essential micronutrients, and, to our surprise, zinc supplies in ancient seawater were much higher and less variable than previously imagined.

Scott, who graduated with a doctoral degree in geological sciences from UCR in 2009, and Lyons were joined in the study by Noah J. Planavsky, a former UCR graduate student in Lyons' lab; Chris L. Dupont at the J. Craig Venter Institute, La Jolla, Calif.; Brian Kendall and Ariel D. Anbar at Arizona State University; Benjamin C. Gill at Virginia Polytechnic Institute and State University and also a former member of the Lyons lab; Leslie J. Robbins and Kurt O. Konhauser at the University of Alberta, Canada; Kathryn F. Husband and Simon W. Poulton at the University of Leeds, United Kingdom; Gail L. Arnold at the Max Planck Institute for Marine Microbiology, Germany; Boswell A. Wing at McGill University, Canada; and Andrey Bekker at the University of Manitoba, Canada.
The idea for the study was a direct consequence of the 2011 Nature paper by Planavsky, Scott, Lyons and others that challenged the hypothesis of broadly sulfidic oceans.
The international collaboration received funding for the study from numerous sources. In the U.S., funding came from the National Science Foundation, the NASA Astrobiology Institute and the Agouron Institute.
